Terms and Conditions

Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using https://thecard.co.in/ website (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

 

Purchases

If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase.

Please note that we strictly process orders upon receipt of advance payments only. We do not accommodate payments after goods have been shipped.

In the rare case where a balance remains unpaid after shipment, and no prior notice or communication is received, the payment must be completed within 4 days of the shipment date. Failure to do so will result in permanent deactivation of your products without further notice.

Subscriptions

Some parts of the Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring subscription charges. Also, please note once you submit the information on Enter Card Details page you will be charged INR 49/- for any changes and / or updations to the information in the card data and / or submitted form.

Subscription services like POWERWEB and SCANMENUS Etc. will be on prepaid basis I.E You will need to pay Every 365 Days (1 Year) or 30 Days (Monthly) in case of SCANMENUS if you wish to keep existing service running for next year / tenure. Failing to make the payment by the end of 12th Month / 365 Days / 1 Year / 30 Days / Next Tenure without any prior intimation your services will be completely stopped and your Account and details will be permanently deleted from our servers and the services will no longer be accessible. Your service commencement date will start from the day we receive your payment and 12 Months / 365 Days / 1 Year / 30 Days will be calculated from commencement date. You would need to place a new order if you wish to use our product again. Our representative may Call / Message / E-Mail / WhatsApp you on the contact information provided by you at the time of placing the order for reminders of the due payment.

Kindly Note: Timely renewal of your plan is the sole responsibility of the Customer / Yours. Under no circumstances shall THECARD or its employees be held liable for any non-functioning or disruption of services resulting from plan expiry.

Recurring Payments

By purchasing a subscription plan on THECARD platforms (including but not limited to thecard.co.in and affiliated subdomains) E.g: POWERWEB (powerweb.thecard.co.in) and SCANMENUS (scanmenus.thecard.co.in), you acknowledge and agree to our recurring billing policy as outlined below:

  1. Automatic Renewal: All subscription plans if Customer had chosen “Recurring Payment” at checkout are automatically renewed at the end of each billing cycle (monthly or yearly, as selected during purchase) unless cancelled before the renewal date.
  2. Payment Authorization: By subscribing, you authorize Tensai Computers Private Limited / THECARD to automatically charge your saved payment method for recurring subscription fees, taxes, or any applicable charges without requiring further approval for each renewal.
  3. Customer Responsibility for AutoPay & Mandates: It is solely the Customer’s responsibility to ensure that automatic renewals, payment mandates, or AutoPay arrangements are active, updated, and properly managed through their respective banks, cards, or payment gateways.
    Under no circumstances shall Tensai Computers Private Limited, THECARD, or any of its employees be held responsible for failed renewals, expired payment methods, or any interruption in service due to customer-side mandate or payment issues.
  4. Cancellation of Mandates / AutoPay: Cancellations of Mandates or AutoPay must be performed entirely by the Customer through their Bank / Card / UPI Control Center or relevant payment management platform. Tensai Computers Private Limited / THECARD does not have access or authority to cancel such automatic payment arrangements on behalf of the customer.
    Customers must take complete responsibility to ensure future AutoPay or Mandate renewals are cancelled from their end if they do not wish to continue the service.
  5. Billing Cycle and Notifications: Renewal dates and amounts are communicated during initial purchase. You may also receive reminder notifications prior to renewal, depending on your payment provider or account settings.
  6. Cancellations and Refunds: Once a renewal is successfully processed, no refunds will be issued under any circumstances. The service will remain active and valid for the renewed period as per the selected plan.
    It is the customer’s responsibility to ensure future Mandates / AutoPay are cancelled to prevent further automatic renewals.
  7. Failed Payments: If an automatic payment fails, the system will retry charging the registered payment method. Continued failure may result in service suspension until payment is successfully completed.
  8. Changes to Subscription or Pricing: THECARD reserves the right to modify subscription pricing, billing cycles, or payment methods without any prior notice. Updated terms will be reflected on the website, and continued use of services will constitute acceptance of such changes. It is the customers responsibility to check the pricing and updated terms before proceeding.

Data Validity / Service Availability

We strive to keep our servers up and running 99.9% of the time. Maximum Tenure we are responsible to keep your data active is 5 Years / 60 Months from your date of Purchase. After the exhaustion time we will still keep your data active but we do not guarantee the same. You will have the option to upgrade to a newer equivalent product.

Content

  • Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material (“Content”).
  • You (“Not We”) are responsible for the content you post or share.

Replacements (Limited to INDIA only)

  • THECARD Products are only eligible for replacement if found to be defective upto 24 Hours from the date of Delivery.
  • Proof of Purchase must be provided.
  • Replacement never covers damages caused by misuse, alterations, accidental damage, environmental effect or colour / print fading.
  • The company reserves the right to refuse a replacement if the product shows signs of intentional damage, tampering, environmental effect or Colour / Print fading.

Printing and Engraving Quality

  • Print / Engraving Standards: THECARD strives to ensure that all printing and engraving on cards meet the highest quality standards. However, slight variations in color, alignment, and finish may occur due to the limitations of printing and engraving processes. These differences are not considered defects and will not be grounds for a return or refund.

  • Color Accuracy: While we make every effort to accurately represent colors, due to variations in screen settings, monitor calibration, and printing equipment, the final product may differ slightly from what appears on your device. THECARD is not responsible for color discrepancies between digital proofs and final prints / engravings.

  • Font and Layout Variations: Upon submission and finalisation of your design, the layout and text will be printed / engraved exactly as submitted, provided that the design is within acceptable formatting limits. THECARD reserves the right to adjust spacing, font sizes, and positioning to ensure optimal print / engraving results, especially if the design causes issues such as text cutoff or misalignment.

  • Material Considerations: The final appearance of the print or engraving may vary depending on the material of the product (e.g., Paper, Wood, Metal, Plastic, PVC, Acrylic etc). Differences in surface texture, finish, and composition of materials may influence the outcome of the printing or engraving process. THECARD is not responsible for any variations in appearance due to the nature of the materials used.

  • Approval of Proofs / Digital Mockups: Before proceeding with the production of your product, we may provide a Digital Proof / Digital Mockups for approval. It is your responsibility to review the proof for accuracy in design, text, and formatting. Once approved, THECARD will not be liable for any errors in the final product that were present in the approved proof.

  • Defects and Errors: If there is a defect or error in the printing or engraving that differs from the approved proof THECARD is not responsible for defects caused by Customer / User error in submitting artwork or design files.

  • Limitations of Liability: THECARD’s liability for any printing or engraving issue is limited to the cost of the defective product. We do not offer compensation for indirect or consequential damages resulting from product defects.

Goods and Service Tax (GST) Limited to INDIA only

Customers who wish to avail GST Input Credit facility should submit their GST Registration Number at the time of placing the order, if the order is manually placed for you by our representative they will ask you for your GST Registration Number at the time of requesting your Billing information if you fail to provide GST Registration Number you will not receive the GST Input Credit. No GST Registration Number submissions will be entertained once the order is placed.

  • Our Service may contain links to third-party web sites or services that are not owned or controlled by THECARD.
  • THECARD has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services.
  • You further acknowledge and agree that THECARD shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

Changes

  • We reserve the right, at our sole discretion, to modify or replace these Terms at any time.
  • What constitutes a material change will be determined at our sole discretion.

SECTION 1 – ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
